כללי

מדיניות הפרטיות להלן חלה על השימוש בשירותי הדיגיטל המקוונים של החברה, הכוללים אתרים ויישומונים (אפליקציות) שונים הבאים המופעלים על ידי החברה, לרבות הפעילות השיווקית של החברה ולהיבטים הנלווים לה, וכן לכלל ערוצי התקשורת איתך באינטרנט, בטלפון, בדואר אלקטרוני, במסרונים, בצ'ט ועוד ("השירותים"). מדיניות פרטיות זו מפרטת את נוהגי עיבוד המידע האישי של החברה בקשר לשירותים.

מדיניות זו מהווה הודעה ובה הפרטים הקבועים בחוק שאנו מחויבים למסור לך בקשר עם פניה אליך לקבלת מידע אישי אודותיך שינוהל על ידינו.

חלק מההיבטים המתוארים במדיניות זו נוגעים גם לנושאים בעלי אופי טכני. מדיניות זו מנסה להסבירם בדרך פשוטה וברורה. ככל שיש לך שאלות בעניין, הנך מוזמן ליצור עימנו קשר.

ניהול והפעלת חלק מהשירותים על ידי החברה היא כחלק מהשירותים שהחברה נותנת ללקוחותיה.

ביחס לשירותים הניתנים לך כחלק מהתקשרות הלקוח עם החברה, הלקוח הוא בעל השליטה במאגר המידע כהגדרתו בחוק הגנת הפרטיות, התשמ"א-1981, והלקוח הוא הקובע הבלעדי והיחידי של מטרות עיבוד המידע בשירותים. בהתאם, החברה היא מחזיקה במאגר המידע של הלקוח.

ביחס לשירותים הניתנים לך כחלק מהתקשרות הלקוח עם החברה, כלל פעולות עיבוד המידע המבוצעות בשירותים כפופות לנוהגי הפרטיות וההודעה של הלקוח.

ביחס לשירותים הניתנים לך כחלק מהתקשרות הלקוח עם החברה, החברה אינה קובעת את מטרות עיבוד המידע ואת אמצעי עיבוד המידע. מטרות עיבוד המידע ואמצעי עיבוד המידע נקבעים באופן בלעדי על ידי הלקוח. כל פעולה במידע מבוצעת אך ורק בהתאם להוראות הלקוח או בהתאם לדין.

אם, לאחר שקראת את מדיניות פרטיות זו או את המדיניות הפרטיות של הלקוח, מצאת שהן אינן תואמות את השקפתך או רצונותיך, עליך להימנע מהשימוש בשירותים ומלמסור מידע אישי אודותיך.

אם לא תיתן את הסכמתך לעיבוד המידע מסגרת השירותים בהתאם למדיניות פרטיות זו, לא תוכל לקבל את השירותים מטעמנו ו/או מטעם הלקוח.

בשל מגבלות השפה העברית, בחלק מהמקרים הניסוח הוא בלשון זכר בלבד, אך מדיניות פרטיות זו מתייחסת כמובן לכל המגדרים.

לצורך מדיניות זו–

"החברה"או "אנו" – מלם שכר בע"מ ו/או סינריון מערכות בע"מ ו/או חברה אחרת מקבוצת מלם תים.

"מידע אישי"הוא כל נתון ומידע הנוגע לאדם מזוהה (להבדיל מחברה או כל תאגיד אחר) או לאדם הניתן לזיהוי. אדם הניתן לזיהוי הינו מי שניתן לזהותו במאמץ סביר, במישרין או בעקיפין, ובכלל זה באמצעות פרט מזהה, כגון שם, מספר זהות, מזהה ביומטרי, נתוני מיקום, מזהה מקוון, או נתון אחד או יותר הנוגע למצבו הפיזי, הבריאותי, הכלכלי, החברתי או התרבותי.

"עיבוד" הוא כל פעולה שמבוצעת על מידע אישי, לרבות קבלתו, איסופו, אחסונו, העתקתו, עיון בו, גילויו, חשיפתו, העברתו, מסירתו או מתן גישה אליו.

"קבוצת מלם תים" הכוללת את כלל החברות בקבוצת מלם תים בע"מ, לרבות חברות בנות, והחברות המסונפות להן.

להלן תקציר של המדיניות כדי להקל על ההתמצאות במדיניות. התקציר איננו בא במקום המדיניות המלאה. ביחס לשירותים הניתנים לך כחלק מהתקשרות הלקוח עם החברה, יש לעיין במדיניות המלאה.

 

מדיניות הפרטיות

1. מידע אישי שאנו מעבדים

אנו מעבדים מידע אישי במסגרת השירותים (כהגדרתם מעלה) והפעילויות הקשורות אליהם, לדוגמה, מידע אישי שאתה מספק לנו, מידע אישי אודות השימוש שלך בשירותים שלנו, מידע אישי אודות השימוש שלך באפליקציה, מידע אישי הקיים במערכות שלנו, ומידע אישי שאנו מקבלים מצדדים שלישיים, לרבות לקוחות החברה.

לא חלה עליך חובה מכוח חוק למסור מידע אישי שנבקש ממך, אולם, בחלק מהמקרים, לא נוכל לספק לך את השירותים בלא לקבל ממך או לאסוף מידע אישי אודותיך.

אנו מעבדים את סוגי המידע האישי הבאים:

(א) פרטים אישיים שאתה מספק לנו בעת השימוש בשירותים 

לדוגמה, כשאתה מתחבר לשירותים, יעובד מידע אישי אודותיך אותו אתה מזין בעת ההתחברות ו/או הנדרש לצורך מתן השירותים כגון: מספר זהות, מספר טלפון וכתובת דואר אלקטרוני.

נאסוף את המידע האישי שתספק לנו גם במסגרת התכתבויות ושיחות שתנהל עם החברה, לרבות פנייה לצוות השיווק או שירות הלקוחות.

לעיתים תספק לנו מידע אישי על אחרים, לדוגמה, מידע על המנהלים שלך או שותפים עסקיים שלך. אתה מתחייב למסור לנו מידע אישי כזה רק אם הדין מתיר לך לעשות זאת.

(ב) מידע אישי בעת השימוש בשירותים

לדוגמה, כשאתה עושה שימוש בשירותים, יעובד מידע אישי אודותיך אותו אתה מזין לשירותים או מידע אישי הקשור לשימוש שלך בשירותים כגון: מידע ממערכות הלקוח שנעשה בו שימוש על ידך במסגרת השימוש בשירותים, וכן מידע ממערכות הלקוח ו/או מידע הנמסר מהלקוח אודותיך או המשמש לצורך תפעול השירותים עבורו.

במסגרת השירותים ייאסף את המידע האישי שתספק גם במסגרת התכתבויות ושיחות שתנהל עם החברה, לרבות פנייה אליה בדואר אלקטרוני. אתה מתחייב למסור לנו מידע אישי רק אם הדין מתיר לך לעשות זאת.

(ג) נתוני תפעול טכניים הנובעים משימוש בשירותים

לדוגמה, נתוני תפעול טכניים הנובעים משימושך בשירותים: פרטי ניסיון וכניסה/התחברות לשירותים, ותיעוד כניסה למערכת ולשירותים (Log Data).

(ד) נתונים אודות השימוש שלך בשירותים ונתונים מהמכשיר שברשותך. נתונים אלה עשויים להכיל מידע אישי.

כלי ניטור טכניים כגון קוקיות, תגי פיקסל וכו' עשויים להיפרס רק לפי הוראות הלקוח, ולצרכים תפעוליים או אנליטיים עבור הלקוח.

ניתן לנהל או לחסום בכל עת בהגדרות הדפדפן או בהתאם למנגנונים העומדים לרשותך.

לדוגמה,

o לוג השימוש (Log Data)

השירותים שלנו רושמים באופן אוטומטי נתונים שנשלחים מערוץ ביצוע הפעולה, לדוגמה מהדפדפן או מהאתר.

לוג שימוש זה כולל לדוגמה את פרטי פרוטוקול כתובת האינטרנט (IP address) שהוקצתה למכשירך לצורך גישה לאינטרנט, פרטי והגדרות הדפדפן, מועד הכניסה, ופעולות שהושלמו ביצוען במסגרת השירותים.

o כלי ניטור

כלי ניטור משמשים לתיעוד פעולותיך ברשתוכוללים קוקיות (Cookies) עוקבנים (Trackers), משואות רשת (Web Beacons), תגי פיקסל (Pixel tags), תגים (Tags) וטכנולוגיות ניטור אחרות.

חלק מהקבצים והמידע האישי שמעובד על ידי כלי הניטור נמחקים כאשר אתה סוגר את הדפדפן שאתה משתמש בו או מסיים את השימוש באתר. אחרים נשמרים על גבי מכשירך גם אחרי סיום השימוש שלך בהם.

מידע נוסף על האפשרויות שלך לנהל, לחסום ולמחוק קוקיות (Cookies) וכלי ניטור נוספים זמין באזור ההגדרות (settings) בדפדפן בו אתה משתמש.

קח בחשבון שחסימה או הסרה של כלי הניטור עשויה להשפיע על חווית השירות שלך, כיוון שיתכן שהיבטים מסוימים בשירותים לא יעבדו בכלל, או יעבדו באופן חלקי ללא השימוש בכלים הללו.

o נתונים שנאספים מכלל המכשירים שלך ולרבות מכשירים ניידים ושיכולים להכיל מידע אישי

לדוגמה, סוג מערכת ההפעלה במכשיר שברשותך, סוג הדפדפן שאתה משתמש בו וכתובת האינטרנט (IP) שהמכשיר שברשותך משתמש בו כדי לגשת לאינטרנט.

ייאסף ממכשירך המידע המפורט להלן אם תאשר ביצוע פעולה זו, וכאשר המידע דרוש לצורך אספקת השירותים. בכל עת תוכל לשלוט באישורים הללו באמצעות אזור ההגדרות במערכת ההפעלה של המכשיר.

(ה) מידע אישי שמתקבל מהלקוח

אנו מעבדים מידע אישי אודותיך אותו הלקוח משתף עם החברה לצורך הספקת השירותים, וכל זאת במסגרת ההתקשרות בין הלקוח לבין החברה.

(ו) כלי ניהול ניתוח שיווק ופרסום

אנו נעזרים בשירותים של ספקים לניהול וניתוח מידע אישי המופק מהשימוש באתרים, ובנכסים הדיגיטליים הנוספים שלנו. שירותים אלה מנטרים את הפעילות באתר שלנו ונותנים לנו פרטים לגבי התנהגות המשתמשים בהם, לדוגמה, מספר המשתמשים שצפו באתר בחודש מסוים, הדפים הנצפים ביותר, פעולות שביצעו משתמשים באתר וכו'.

אנו נעזרים בשירותי ספקים גם לצורכי שיווק ופרסום, באתר של החברה וכן באתרים וביישומים אחרים וברשתות חברתיות. שירותים אלה משתמשים בקוקיות ובכלי ניטור נוספים לשם איסוף נתונים. שירותים אלה משמשים אותנו לצרכי פרסום ברחבי הרשת (לא רק באתר). הפרסום יותאם להעדפותיך על בסיס מאפייני פעילותך בשירותים ומידע נוסף.

לדוגמה, קבוצת מלם תים משתמשת בכלים לניתוח ואנליטיקה של החברות Google ו - Meta, וכן משתמשת בשירותיהן לצורכי קמפיינים פרסומיים ולהתאמה אישית של מודעות. שירותים אלה אוספים נתונים כדוגמת נתוני גישה ושימוש ופעולות שביצעת באתר, והספקים המפעילים משתמשים בנתונים בהתאם למסמכי מדיניות הפרטיות שלהם ובאחריותם. מסמכי המדיניות של החברות Google ו - Meta זמינים בכתובות:

ניתן למנוע את איסוף המידע האישי אודותיך באמצעות התקנת תוסף לדפדפן, כדוגמתGoogle Analytics Opt-Out Browser Add-on.

בנוסף, ניתן למנוע או להגביל איסוף מידע אודותיך על ידי הכלים הללו באמצעות הגדרות הדפדפן ומערכת ההפעלה של המכשיר שברשותך.

(ז) מידע אישי שמתקבל מצדדים שלישיים אודותיך ואודות גורמים הקשורים אליך

אנו מקבלים מידע אישי אודותיך מגורמים שונים, כגון:

o צדדים קשורים לקבוצת מלם תים, לחברות הבת שלה, ולחברות המסונפות לה;

o שותפים עסקיים;

o שירותי דיוור ישיר כמשמעותם בחוק הגנת הפרטיות, התשמ"א-1981;

o הלקוח מוסר מידע לחברה במסגרת התקשורת שבינו לבין החברה.

(ח) מידע אישי המפורסם באופן פומבי

מידע אישי ממאגרי מידע אחרים, ממאגרים פומביים, בהתאם להוראות כל דין וכן מידע המפורסם בפומבי באינטרנט.

(ט) מידע אישי המשותף בתוך קבוצת מלם תים

מידע אישי המשותף בתוך קבוצת מלם תים לצורך מתן השירותים (כהגדרתם מעלה), וכן שירותים נוספים הניתנים על ידי חברות בת אחרות מקבוצת מלם תים, לרבות תחזוקה, שיווק, קשרי לקוחות, ממסר הודעות, ועמידה בדרישות כל דין.

2. מטרות עיבוד המידע האישי

אנו מעבדים את המידע, בין היתר, כדי לספק לך, למשתמשים, וללקוחות החברה את השירותים (כהגדרתם מעלה) והפעילויות הקשורות אליהם, לשפר שירותים קיימים ולפתח חדשים, לנהל תקשורת איתך ועם אחרים, לשתף פעולה באספקת שירותים, להגן עליך, על החברה ועל לקוחותיה, שותפיה, ספקיה וכל צד שלישי רלוונטי אחר, לצורכי ניהול ובקרה שוטפים ועל מנת לתקשר איתך, לשלוח לך מידע בהתאם לדרישות הדין ותוכן פרסומי ולמטרות נוספות כמפורט בפרק זה.

ביחס לשירותים הניתנים לך כחלק מהתקשרות הלקוח עם החברה, החברה אינה קובעת את מטרות עיבוד המידע ואת אמצעי עיבוד המידע. במקרים אלו מטרות עיבוד המידע ואמצעי עיבוד המידע נקבעים באופן בלעדי על ידי הלקוח. כל פעולה במידע מבוצעת אך ורק בהתאם להוראות הלקוח או בהתאם לדין.

אנו מעבדים מידע אישי אודותיך למטרות הבאות:

(1) כדי לאפשר לך להשתמש בשירותים המוצעים על ידי החברה או קבוצת מלם תים.

(2) למטרות עסקיות שלנו אנו משתמשים בכלי ניתוח ועיבוד מידע, לרבות כלים של ספקים שלנו כדי לספק לך את השירותים ולסייע לנו בפעילות השוטפת הכרוכה במתן, ניהול, בקרה, תכנון ואבטחת שירותינוומערכות המידע שלנו, כדי לשפר את שירותינו הקיימים, לרבות אסטרטגית, ולפתח, לנהל ולספק שירותים חדשים, לנתח ולעבד מידע לצרכים עסקיים של קבוצת מלם תים, ובכלל זה בצורה מצרפית (אגרגטיבית) וסטטיסטית, כדי לזהות את העדפותיך ולהתאים את השירותים אליהם וכן למטרות ניהול ובקרה נוספות.

(3) להגן על הזכויות והנכסים שלך ושל לקוחות אחרים, על האינטרסים של החברה או קבוצת מלם תים, של שותפיה העסקיים, של ספקיה, של גופים אחרים הקשורים אליה, על הזכויות של נושאי תפקיד בהם ושל אנשים נוספים הקשורים לחברה (כדוגמת אורחי החברה), וכדי למנוע או להקטין נזק והוצאות מכל סוג.

לדוגמה, לאתר ניסיונות שימוש בלתי מורשה, שימוש לרעה, הונאות הקשורות בשירותי החברה, מניעה וטיפול באירועים זדוניים מכל סוג, לרבות באמצעות פעולות מעקב וניטור.

(4) כדי להתאים אישית תוכן ומודעות פרסומיות ולהציג אותם לך, ללקוחות אחרים של החברה או קבוצת מלם תים ולמשתמשי האתר, וכן לפרסם ברחבי האינטרנט, לרבות ברשתות חברתיות ובמדיות דיגיטליות נוספות.

(5) לנהל סיכונים והליכים משפטיים ומנהליים וכן כל הליך אחר בפני רשות מוסמכת.

(6) להציג לך וללקוחות אחרים של קבוצת מלם תים מידע מצרפי (אגרגטיבי) וניתוחי (אנליטי) ומידע נוסף, וזאת כדי לספק ולשפר את השירותים.

(7) לצורכי הדרכה ועדכונים רלוונטיים לעובדים, הנהלה, ספקים ושותפים עסקיים ולצורכי תחקור פנימי ולימוד אירועים מכל סוג הקשורים לשירותים ולמערכות שלנו.

(8) כדי למלא אחר הוראות הדין, וכן הוראות, דרישות ובקשות של רשויות פיקוח ואכיפה, רשויות חוקרות ואחרות, בארץ ובעולם.

(9) כדי לאכוף את תנאי השימוש או מדיניות הפרטיות של החברה או של חברה אחרת בקבוצת מלם תים.

ביחס לשירותים הניתנים לך כחלק מהתקשרות הלקוח עם החברה, כל פעולה המבוצעת במידע נעשית בלבד לשם:

(א) אחסון, אבטחה, גיבוי, שחזור וניהול גישה למידע עבור הלקוח.

(ב) הפעלת השירותים מטעם הלקוח.

(ג) תיעוד ותפעול תקלות בשירותים וכן ניטור אבטחת השירותים.

(ד) סיוע טכני ללקוח בביצוע מטלותיו – אך ורק על פי הוראותיו ובאחריותו.

(ה) עמידה בדין ובהוראות רשויות מוסמכות, לרבות ניהול אירועים משפטיים ומניעת הונאות – וככל הניתן, בתיאום ובמתן הודעה ללקוח.

3. האפשרויות והבחירות שלך

לרשותך מספר רב של אפשרויות לקבוע את ההעדפות שלך בנוגע לשימוש במידע האישי אודותיך. לדוגמה, בכל עת אתה רשאי להודיע לנו לעדכן את המידע האישי אודותיך. אתה יכול לצמצם את איסוף מידע המבוסס על כלי ניטור.

בנוסף, מוקנית לך הזכות לעיין במידע האישי שנאסף אודותיך, ולבקש את תיקונם או מחיקתם של פרטים שאינם נכונים, שלמים, ברורים או מעודכנים, בהתאם למדיניות זו, ובכפוף להוראות הדין

בחירות רבות מוגדרות בתוך השירותים ולצידן תוכל להשתמש בהגדרות הדפדפן שאתה משתמש בו ובהגדרות מערכת ההפעלה של המכשיר הנייד שברשותך כדי להתאים את עיבוד המידע האישי להעדפותיך. לדוגמה, תוכל:

(1) לשנות את העדפותיך בנוגע לשירותים אינטרנטיים ושירותי תקשורת אחרים, לדוגמה, להסיר את עצמך משירותים ופעולות מבוססי מיקום באמצעות המכשיר שלך ככל שהוא מאפשר זאת, או לשנות את הסכמותיך ביחס לקבלת, העברת ושימוש במידע על ידינו. תוכל לעשות זאת באמצעות פנייה לחברה ומעת לעת נוכל להציע לך דרכים נוספות לשינוי העדפותיך.

(2) למנוע מהחברה ומספקיה מלהציב קוקיות ולהשתמש בכלי ניטור נוספים במכשיר שברשותך באמצעות ההגדרות של הדפדפן שאתה משתמש בו וההגדרות במכשיר הנייד שלך. יש לקחת בחשבון שפעולה כזו עלולה לשבש את היכולת שלך להשתמש באתר.

(3) לבטל או לצמצם את הרשאת הגישה, או הסכמתך להעביר מידע אישי. החברה תאפשר לך לעשות זאת בכל עת באמצעות פנייה אלינו.

(4) לאסור או להגביל את השימוש במזהה הפרסום במכשיר הטלפון שברשותך, בהתאם לאפשרויות וההגדרות של מערכת ההפעלה של המכשיר שברשותך.

ביחס לשירותים הניתנים לך כחלק מהתקשרות הלקוח עם החברה, מימוש זכויותיך כנושא מידע לפי הדין (למשל: עיון, תיקון, מחיקה וכו') ייעשה בהתאם לדין, וזאת לאחר פנייה ללקוח.

האפשרויות והבחירות שלך:

(א) בנוגע להעדפות לגבי קוקיות/כלי ניטור בהתאם לתנאי מדיניות פרטיות זו. לרשותך מספר רב של אפשרויות לקבוע את ההעדפות שלך בנוגע לשימוש במידע האישי אודותיך. לדוגמה, בכל עת אתה רשאי להודיע לנו לעדכן את המידע האישי אודותיך. אתה יכול לצמצם את איסוף מידע המבוסס על כלי ניטור

(ב) בנוגע לשינוי הסכמות והעדפות תקשורת – יבוצעו באמצעות מנגנוני ההסרה שהלקוח מעמיד לרשותך. פניות שהחברה תקבל בעניין ינותבו ללקוח. בחירות רבות מוסדרות התקשרות הישירה שלך עם הלקוח ולצידן תוכל לבקש ביצוע השינויים כאמור.

(ג) בנוגע בקשות למימוש זכות העיון, זכות התיקון וזכות המחיקה – יש לפנות ללקוח למימוש הזכויות המוקנות מכוח חוק הגנת הפרטיות, התשמ"א-1981. פניות שהחברה תקבל בעניין ינותבו ללקוח. הזכות לעיין במידע האישי שנאסף אודותיך, ולבקש את תיקונם או מחיקתם של פרטים שאינם נכונים, שלמים, ברורים או מעודכנים, יבוצעו בהתאם להנחיות הלקוח, ובכפוף להוראות הדין.

4. שיתוף מידע אישי

כחלק מתפעול הפעילות השוטפת ואספקת השירותים וכדי לממש את מטרות השימוש במידע האישי אודותיך בהתאם למדיניות זו, אנו משתפים מידע אישי עם חברות בתוך החברה ועם חברות נוספות, ארגונים וגופי ממשל.

לדוגמה,

(1) עם קבוצת מלם תים.

(2) עם חברות המסייעות לנו לספק לך את השירותים, כדוגמת חברות אחסון מידע, חברות המתפעלות את השירותים ועוד.

(3) עם חברות המסייעות לנו לממש את המחויבות שלנו כלפיך וכלפי המידע האישי אודותיך, כדוגמת חברות אבטחת מידע ומניעת הונאות.

(4) עם חברות המסייעות לנו לשמור על הזכויות שלך, של לקוחות נוספים של החברה, של החברה עצמה ושל שותפיה וספקיה, לדוגמה, יועציה המשפטיים של החברה.

(5) עם גופים מוסמכים ורשויות שונות, וכן עם רשויות פיקוח, אכיפה, רשויות חוקרות ואחרות, בארץ ובעולם.

(6) עם חברות העוסקות במחקר, ביצוע סקרים, פרסום וניתוח מידע לצורך פיתוח מוצרים חדשים, עדכון ושיפור מוצרים קיימים, קבלת פרסום מותאם ואספקת שירותי החברה ללקוחותיה.

ביחס לשירותים הניתנים לך כחלק מהתקשרות הלקוח עם החברה, שיתוף מידע ייעשה רק כמפורט להלן:

לדוגמא,

(7) עם הלקוח, לצורך ניהול השירותים ובקשות שהופנו על ידך.

(8) עם חברות המסייעות לנו לספק את השירותים, כדוגמת חברות אחסון מידע, חברות המתפעלות את השירותים ועוד.

(9) עם חברות המסייעות לנו לממש את המחויבות שלנו בהתאם למדיניות פרטיות זו, כדוגמת חברות אבטחת מידע ומניעת הונאות.

(10)עם גופים מוסמכים ורשויות שונות, וכן עם רשויות פיקוח, אכיפה, רשויות חוקרות ואחרות, בארץ ובעולם – רק אם החברה מחויבת לכך לפי דין או לפי הוראות הלקוח.

5. השפעת שינויים במבנה החברה על המידע האישי

גם אם יחולו שינויים במבנה החברה נמשיך לפעול לפי מדיניות זו.

אם נמזג את פעילותנו עם חברה אחרת, נרכש על ידי חברה אחרת, נשנה את המבנה התאגידי שלנו, נעביר או נמכור פעילות או שירות שלנו, החברה החדשה תיכנס בנעלינו ותשתמש במידע האישי אודותיך בהתאם למדיניות הזו.

Regarding the services provided to you as part of the customer's engagement with the Company, the customer is the controller of the database as defined in the Privacy Protection Law – 1981, and the customer is the exclusive and sole determiner of the purposes of processing information within the Services. Accordingly, the Company holds the customer's database.

Regarding the services provided to you as part of the customer's engagement with the Company, all information processing actions carried out in the Services are subject to the customer's privacy practices and notices.

Regarding to the services provided to you as part of the customer's engagement with the Company, the Company does not determine the purposes or means of information processing. The purposes and means of information processing are determined exclusively by the customer. Any action with the information is performed solely in accordance with the customer's instructions or in accordance with the law.

If, after reading this Privacy Policy or the Customer's Privacy Policy, you find that they do not align with your views or preferences, you should refrain from using the Services and from providing personal information about yourself.

If you do not consent to the processing of information in under the Service in accordance with this Privacy Policy, you will not be able to receive the services from us and/or from the customer.

For the purpose of this Policy –

“The Company” or “We” – Malam Payroll Ltd. and/or Synerion Systems Ltd. and/or another company from the Malam Team Group.

“Personal Information” means any data and information relating to an identified person (as opposed to a company or any other corporation) or an identifiable person. An identifiable person is someone who can be identified with reasonable effort, directly or indirectly, including by means of an identifier, such as a name, an identity number, a biometric identifier, location data, an online identifier, or one or more information relating to their physical, health, economic, social or cultural status.

“Processing” means any action which is carried out on personal information, including its receipt, collection, storage, copying, reviewing, disclosure, transfer, delivery or access to it.

"Malam Team Group" includes all companies in the Malam Team Group Ltd. including subsidiaries and affiliated companies.

Privacy Policy

1. Personal Information We Process

We process personal information as part of the Services (as defined above) and their related activities, for example, personal information you provide to us, personal information about your use of our Services, personal information about your use of the application, personal information existing in our systems, and personal information we receive from third parties, including the Company's customers.

You are not required by law to provide personal information that we request from you, however, in some cases, we cannot provide you with the Services without receiving or collecting personal information about you.

We process the following types of personal information:

(a) Personal information that you provide to us when using the Services

For example, when you log in to the Services, personal information about you that you enter upon login and/or that is required for the provision of the Services, such as: identity number, telephone number and email address, will be processed.

We will also collect the personal information that you provide to us as part of correspondence and conversations that you have with the Company, including contact with the marketing or customer service team.

Sometimes you will provide us with personal information about others, for example, information about your managers or business partners. You undertake to provide us with such personal information only if the law permits you to do so.

For example, when you use the Services, personal information about you that you enter into the Services or personal information related to your use of the Services will be processed, such as: information from the customer's systems that is used by you as part of the use of the Services, as well as information from the customer's systems and/or information provided by the customers about you or used for the purpose of operating the Services for them.

As part of the Services, the personal information that you provide will also be collected in correspondence and conversations that you conduct with the Company, including contacting it by e-mail. You undertake to provide us with personal information only if the law permits you to do so.

(c) Technical operational data resulting from the use of the Services

For example, technical operational data resulting from your use of the Services: details of attempts and login/connection to the Services, and recording of login to the system and services (Log Data).

(d) Data about your use of the Services and data from your device. This data may contain personal information.

Technical monitoring tools such as cookies, pixel tags, etc. may only be deployed according to the instructions of the Customer, and for operational or analytical needs for the Customer.

This can be managed or blocked at any time in the browser settings or in accordance with the mechanisms available to you.

For example:

o Log Data

Our Services automatically record data that is transmitted from the channel through which the action is performed, for example from the browser or the website.

This log data includes, for example, the Internet Protocol address (IP address) assigned to your device for accessing the Internet, browser details and settings, login time, and actions performed within the Services.

o Monitoring Tools

 

Monitoring tools are used to record your activities on the network and include cookies, trackers, web beacons, pixel tags, tags and other monitoring technologies.

Some of the files and personal information processed by the monitoring tools are deleted when you close the browser you are using or finish using the website. Others are stored on your device even after you have finished using them.

We process personal information about you that the customer shares with the Company for the purpose of providing the services, all within the framework of the engagement between the customer and the Company.

(f) Advertising analysis management and marketing tools

We use the services of suppliers to manage and analyze personal information generated from the use of the websites and our other digital assets. These services monitor the activity on our website and provide us with details about the behavior of users on them, for example, the number of users who viewed the website in a particular month, the most viewed pages, actions performed by users on the website, etc.

We also use the services of suppliers for marketing and advertising purposes, on the Company's website as well as on other websites and applications and on social networks. These services use cookies and other monitoring tools to collect data. These services are used by us for advertising purposes throughout the network (not only on the website). Advertising will be tailored to your preferences based on the activity characteristics within the services and additional information.

For example, Malam Team Group uses Google and Meta analysis and analytics tools, and uses their services for advertising campaigns and ad personalization. o Direct mailing services as defined in the Privacy Protection Law – 1981;

o The customer provides information to the Company as part of the communication between him and the Company.

(h) Publicly published personal information

Personal information from other databases, such public databases, in accordance with the provisions of any law, as well as information published publicly on the Internet.

(i) Personal information shared within the Malam Team Group

Personal information shared within the Malam Team Group for the purpose of providing the Services (as defined above), as well as additional services provided by other subsidiaries of the Malam Team Group, including maintenance, marketing, customer relations, message transmission, and compliance with any law.

2. Purposes of Processing Personal Information

We process the information, among other things, to provide you, the users, and the Company's customers with the Services (as defined above) and related activities; to improve existing services and develop new ones; to communicate with you and others; to cooperate in providing services; to protect you, the Company, its customers, partners, suppliers, and any other relevant third party; for ongoing management and control purposes; and to communicate with you, to send you information in accordance with legal requirements and advertising content, and for additional purposes as detailed in this chapter.

Regarding the services provided to you as part of the customer's engagement with the Company, the Company does not determine the purposes and means of information processing. In these cases, the purposes and means of information processing are determined exclusively by the customer. Any action on the information is performed solely in accordance with the customer's instructions or in accordance with the law.

We process personal information about you for the following purposes:

(1) To enable you to use the services offered by the Company or the Malam Team Group.

(2) For our business purposes, we use data analysis and processing tools, including tools from our suppliers, to provide you with the services and to assist us in the ongoing activities involved in providing, managing, controlling, planning and securing our services and our information systems; to improve our existing services, including strategically, and to develop, manage and provide new services; to analyze and process information for the business needs of Malam Team Group, including in an aggregated and statistical form, to identify your preferences and adapt the services to them, as well as for additional management and control purposes.

(3) To protect your rights and assets and those of other customers, the interests of the company or Malam Team Group, its business partners, its suppliers, other entities related to it, the rights of those in charge of them and other people related to the Company (such as company guests), and to prevent or reduce damage and expenses of any kind.

For example, to detect unauthorized use attempts, misuse or fraud related to the Company's services, prevent and handle malicious events of any kind, including through tracking and monitoring actions.

(4) To personalize content and advertising and display them to you, other customers of the Company or Malam Team Group and users of the website, as well as to advertise throughout the Internet, including on social networks and other digital media.

(5) To manage risks and legal and administrative proceedings, as well as any other proceedings before a competent authority.

(6) To display aggregated and analytical information and additional information to you and other customers of Malam Team Group, in order to provide and improve the Services.

(7) For training purposes and relevant updates to employees, management, suppliers and business partners and for internal investigation and study of incidents of any kind related to our services and systems.

(8) To comply with the provisions of the law, as well as the provisions, requirements and requests of supervisory and enforcement authorities, investigative authorities and others, in Israel and around the world.

With respect to the services provided to you as part of the customer's engagement with the Company, any action performed on the information is done solely for the purpose of:

(a) storing, securing, backing up, restoring and managing access to information for the customer.

(b) operating the services on behalf of the customer.

(c) documenting and operating service incidents as well as monitoring the security of the services.

(d) providing technical assistance to the customer in performing his tasks – solely according to his instructions and under his responsibility.

(e) complying with the law and the provisions of competent authorities, including managing legal events and preventing fraud – and, to the extent possible, in coordination with and providing prior notice to the customer.

3. Your Choices and Options

You have a number of options to set your preferences regarding the use of your personal information. For example, at any time you may notify us to update your personal information. You may restrict the collection of information based on monitoring tools.

In addition, you have the right to review the personal information collected about you, and to request the correction or deletion of information that is inaccurate, incomplete, unclear or outdated, in accordance with this Policy, and subject to the provisions of the law.

Many choices are set within the Services and in addition, you can use the browser settings you use and the operating system settings of your mobile device to adapt the processing of personal information to your preferences. For example, you may:

(1) Change your preferences regarding online and other communication services, for example, to remove yourself from location-based services and activities using your device to the extent it allows, or change your consents regarding the receipt, transfer and use of information by us. (a) Regarding cookies/monitoring tools preferences in accordance with the terms of this Privacy Policy. You have a number of options to set your preferences regarding the use of your personal information. For example, at any time you may notify us to update your personal information. You can reduce the collection of information based on monitoring tools.

(b) Regarding changing consents and communication preferences – these will be done through the removal mechanisms that the customer makes available to you. Inquiries that the Company will receive in this regard will be directed to the customer. Many choices are regulated by your direct communication with the client and you can request the implementation of such changes.

(c) Regarding requests to exercise the right of reviewal, the right of correction and the right of deletion – the customer must be contacted to exercise the rights granted by virtue of the Privacy Protection Law – 1981. Requests that the Company receives in this regard will be directed to the customer. The right to review the personal information collected about you, and to request the correction or deletion of information that is incorrect, incomplete, unclear or outdated, will be carried out in accordance with the customer's instructions, and subject to the provisions of the law.

4. Sharing Personal Information

As part of the operation of the ongoing activity and the provision of the Services and in order to realize the purposes of using personal information about you in accordance with this Policy, we share personal information with companies within the Company and with other companies, organizations and government bodies.

(1) with the Malam Team Group.

(2) with companies that help us provide you with the Services, such as data storage companies, companies that operate the services and others.

(3) with companies that help us fulfill our commitment to you and your personal information, such as information security and fraud prevention companies.

(9) with companies that help us fulfill our obligations under this Privacy Policy, such as information security and fraud prevention companies.

(10) with authorized bodies and various authorities, as well as with supervisory, enforcement, investigative and other authorities, in Israel and around the world – only if the company is obligated to do so by law or according to the customer's instructions.

 

5. Impact of Changes in the Company's Structure on Personal Information

Even if there are changes in the Company structure, we will continue to operate in accordance with this Policy.

If we merge our operations with another company, are acquired by another company, change our corporate structure, transfer or sell our operations or services, the new company will step into our shoes and use your personal information in accordance with this Policy.

With respect to the Services provided to you as part of the customer's engagement with the Company, the transfer of ownership of the information, to the extent required, will be carried out subject to law and agreements with the customer, while maintaining the continuity of information security measures and information confidentiality.

6. Statistical and Non-Identifying Information

We use statistical data and additional non-identifying data for business purposes. Such analysis allows us, for example, to present you and other customers with information that is tailored and relevant to you and a group of people with similar characteristics.

In the digital age, many services rely on the use and processing of statistical data. The uses are very diverse and assist, among other things, in generating business insights, information security, optimizing information organization efforts, development and innovation.

We will use personal information about you and others to generate and process statistical and non-identifying data. This type of information will no longer be considered personal information and is not subject to privacy protection laws. We will collect, transmit and share this type of information for business and administrative purposes. When we use this type of information, we will not take any action that knowingly identifies you.

7. Personal Information for Direct Mailing Purposes

Based on your choice and consent, we use direct mailing services. If you have voluntarily chosen to share your contact details with the Company, you hereby give your consent that this information will be stored in the Company's or Malam Team Group's systems for the purpose of sending marketing, promotional and direct mailing materials on behalf of Malam Team Group.

At any time, you may remove yourself from the mailing list using the unsubscribe link provided in the mailing messages or by contacting us in writing via "Contact Us" in this Policy or on the website. The removal may take up to 14 business days from the date of receipt of the request. The company will not provide your personal information to advertisers. With respect to the services provided to you as part of the customer's engagement with the Company, the duration of data retention is determined exclusively by the customer. We will retain the information in accordance with the customer's instructions and subject to the requirements of the law.

10. Personal Information About Children

As a general rule, the Company's services are not intended for children, and the Company does not knowingly collect personal information about children.

If this information is collected by the Company or provided by children, children who have received consent from their parents or legal guardian, this information will be handled solely in accordance with the customer's instructions and/or in accordance with the law.

11. Changes to the Privacy Policy

From time to time, changes may occur to this Privacy Policy, resulting from changes in the law, regulations and regulatory guidelines, or due to changes in the business environment, the nature and quality of the services provided by the Company, technological changes, and more.

According to the customer's instructions, we may use personal information about you and others to generate and process statistical and non-identifying data. Such information will no longer be considered as personal information and is not subject to privacy laws.

We secure and protect your personal information in accordance with the generally accepted standards that are embedded in the Company's procedures and are consistent with the provisions of the law and regulations applicable to the Company.

We implement numerous systems, technical processes and procedures to secure personal information related to you, to minimize the risks of theft, damage, loss of information or unauthorized access or use of information.

These systems reduce security risks. However, it is important to understand that although we invest significant resources in cybersecurity and information security, no security system is impenetrable. Although we make efforts to protect your privacy, unfortunately we cannot guarantee that the Services will be immune from wrongdoings, malfunctions, illegal access, or other types of misuse or unauthorized use.

This Policy applies only to our Services and concerns the activity on the Services only.

The Services may use and include references to other applications, websites or businesses – where the activity is not managed by us. Their privacy practices may be different and are under the control and responsibility of these other entities.
